Abstract

From time immemorial, women have been the most vulnerable section of the society who have been denied of their rights and abused in today’s society. At the same time, modern societies claim that human rights are recognized and enjoyed. It is true that socio-cultural norms, religious beliefs, patriarchal family setting and dominance of male counterparts of women contribute to the regular forms of discrimination against women. This discrimination is predominant in matters of marriage and family. The fundamental and natural rights attached with human beings that are essential for a person to lead a life with dignity as a human being are known as human rights. They are not the creation of any State or law, but inherent in every person by virtue of being human and are ascribed naturally by virtue of being born as a human being. The Universal Declaration of Human Rights 1948 declares that “all human beings are born free and equal in dignity and rights.” But do women, though an integral part of society, are able to enjoy many human rights like equality without which the constitutional mandate of creation of an egalitarian society is not possible? It is true that in practice they are denied to women.This article highlights the status of women especially in matrimonial sphere, wherein they are treated unequally, met with injustice and forced to lead and leave their lives miserably without receiving the very basic human rights. The author identifies that the matrimonial laws whether they are personal laws or not, shall be interpreted in terms of accommodating the human rights and a new matrimonial jurisprudence shall be emerged encompassing a holistic human rights perspective in to it.
