Title

Critical Analysis of Corporate Insolvency Resolution Process under Insolvency and Bankruptcy Code, 2016

Abstract

The Corporate Insolvency Resolution Process (CIRP) is a key component of the Insolvency and Bankruptcy Code 2016 (IBC) in India. It is a legal mechanism aimed at resolving insolvency issues for corporate entities. During CIRP, a corporate debtor undergoes a timebound process to find a resolution plan and avoid liquidation. Section 7 to Section 32 of the IBC 2016 governs the CIRP. This study will critically examine the steps which are to be followed under CIRP. It offers a critical examination of the CIRP within the broader context of insolvency frameworks, focusing on its procedural intricacies, practical implications, and effectiveness in achieving its objectives. Further the research work will discuss about Initiation of CIRP, Appointment of Insolvency Professional, Committee of creditors, Moratorium period, Resolution plan and approval of resolution plan by NCLT. This study will also focus on time limit of every step and procedure which has to be followed to complete Corporate Insolvency Resolution Process. This study will also analyze various cases laws relating to Corporate Insolvency Resolution Process. By identifying areas of improvement, this research aims to contribute to the ongoing discourse on corporate insolvency resolution frameworks, with the ultimate goal of fostering a more robust and efficient insolvency regime in India.
