India’s rich biodiversity has always attracted research and development in the field of agriculture and allied ventures. India is a member under developing nations of World Trade Organisation and signatory to Agreement on Trade-related aspects of Intellectual Property Rights. Therefore India is obligated to protect the plant varieties either by means of granting patents or by sui generis protection. By virtue of its obligation under TRIPS, India passed a sui generis legislation with objectives of promoting the protection of plant varieties and plant genetic resources. Not only protecting the plant breeders the law also intends to recognize and protect the rights of the farmers. A Nodal authority is also been established to ensure proper implementation of the legislation. This paper attempts to understand the degree of achievement of the objectives underlying the passage of the sui generis law.
