Title

Can Hashtag (#) be a Trade Mark in Indian Context?

Abstract

In today context, social media has been extensively used to fulfil the business objectives of creating brand awareness and acquisition of customers. These social media are becoming as branding efforts of many marketing companies to reach the targeted customers. Among the branding tools used by the social media, the Hashtag (#) prominently has taken spotlight and registered as trade mark globally by many companies in the present decade. There is huge awareness among the owners, entrepreneurs about the use of Hashtag in the social media campaigns and registered as trademark. In India the use of Hashtag has been increased over the years, but still there is a question as per the Indian trade mark law the Hashtag be considered for registration. In this above context this paper explores the significance of using Hashtag in India, and how it has been used internationally? Can Hashtag be registered as a Trade Mark? Whether the Hashtag be registered in India as per the Indian Trade Mark Law presently exist?
