The present criminal justice system is that it has been suffering from innumerable defects. Conviction rate is extremely low which reflects the working of the police, the prosecuting agency and non-cooperative attitude of the public in assisting the prosecuting agency in the courts of justice. There are prolonged delays, frequent adjournments and lack of coordination between police, investigation and judiciary. Criminals are not deterred. New types of crime are proliferating. Vulnerable sections of the society like women, children and other members of weaker section of society like the Scheduled Caste and Schedule Tribes are adversely affected and the present Criminal Justice System has failed to live up to their expectations. Politicians, bureaucrats and investigating agencies are hand in gloves with each other. The law and order situation has deteriorated and a common man has lost faith in our judicial system. The present paper is an attempt to discuss various lacunas in Criminal justice system and proposes for the establishment of the Alternative Dispute Resolution i.e. arbitration, reconciliation, mediation and Lok- Adalats for reducing the burden of courts.
