The objective behind this research is to analyze the decriminalization of Sec.377 of the IPC (1860) only in context with homosexuality in India and with considering the male and female section (homosexual) for their protection against the rape. Homosexuality is a matter of personal choice and depends upon the hormonal changes in the human body but this research will help me to analyse the lacunas in decriminalization in Sec.377 in context with providing the protection to the homosexuals against the rape and ask the Government of India that, why the Government of India has still not proposed or framed any law regarding the “homosexual rape”? In this research the researcher ( I ) just want to analyze the present report regarding the decriminalization of Sec.377 of IPC and the rape cases in India related to homosexual community with the lacking in criminal laws in India.
