Title

A Comparative Discourse on the Issue of Higher age of Sexual Consent

Abstract

Albeit the role of legislator is to legislate law but certainly it is not confined to making laws as the development of a society depends upon the ‘quality of laws’ legislated by the law makers. The provision dealing with age of sexual consent ought to be condemned for functioning in contradiction with the aims and objectives for which it had been enacted. What is often suggested by the term ‘age of consent’ is ‘age of liability’ for the perpetrator rather than age of consent which renders the term controversial in itself. It is argued that ‘age of sexual consent’ is a certain age determined by the law of a country whereby it is made permissible for a child to indulge in sexual intercourse. However, it has not much to do anything with consent. Thus, an attempt has been made to refurbish the gaffes made in the formulation of the very structure and enforcement of the Contemporary Statutory Rape Laws in the legal frame of the country based on a comparative analysis with an international paradigm. This narrative encompasses the background and rationale of study, the aims and objectives as well as the significance of the study, the review of literature to divulge the need of present study. The study further includes the statement of problem and the research methodology adopted. The study is based on a comparative analysis of statutory Rape Laws across the various legal systems in the world. Ultimately, some suggestions have been put forth in order to propose the best paradigm to regulate teenage sexuality.
