Judicial Activism is one of the term that can be use to define the rulings of judiciary which are suspected to be based upon the considerations relating to the personal and political aspects and other than the existing laws. Some proponents of stronger judiciary argued at the judiciary help provides check and balances and should grant itself an expanded role to counter balance the effects of transient majoritarianism. At presently we have the drug laws to fight the drug abuse but there is a lack of implementation and further have conflicting interest between these laws. This paper is focusing on the Judicial Activism’s and its role in India. It is an evaluation of NDPS Act, 1985 in relation to the Drugs and Cosmetics Act, 1940 with various judicial interpretations to balancing the drug laws. This study is an attempt to provide that the Judicial Activism is filing the gap between these laws in order to combat the drug abuse.
