Title

Safeguarding the Future: The Judiciary's Impact on Children's Rights in India through Landmark Judgments

Abstract

Childhood a precious stage of human life and acknowledging the vulnerability of children, the international community has taken significant steps towards their protection. Various declarations such as the Declaration of the Rights of the Child, initiatives like the United Nations Children’s Fund, and conventions such as the Convention on the Rights of the Child, ratified by many nations including India, highlight the commitment of the world community towards safeguarding children’s rights. Furthermore, the Constitution of India enshrines provisions for the rights of children, serving as the cornerstone for the enactment of Indian legislations aimed at their protection. Despite the profusion of laws defining the various rights of children, offenses against them, such as child sexual abuse, kidnapping, child labour, and child marriage, etc continue to persist. The huge gap between legislation and implementation continues to be a pressing concern. Consequently, the judiciary assumes a pivotal role in delineating specific rights of children where legislative efforts and due implementation fall short. This paper seeks to highlight the landmark judgments delivered by Indian courts, acting as custodians of child rights by issuing directives and ensuring proper measures for the prevention of crimes against them. Through judicial intervention, avenues for the protection and welfare of children are created, reinforcing the collective commitment of all towards ensuring a secure and nurturing environment for the youngest members of our society.
