Title

STATUS OF CONTRACT LABOUR: A SOCIO-LEGAL PERSPECTIVE (WITH SPECIAL REFERENCE TO ODISHA).

Abstract

Labour are the backbone of a country. Infra-structural development of the country depends upon ethical practice of employer-employee relationship of the industry. There is no scope of thinking about individual rights. India is belonging to a democratic country and a part of globalization. In a globalised market employment structure also changes day by day. Now a day’s in this globalise market the rights of the labourer are affected very much. Exploitation is a prima-facie issue for the contract labourer. Like that contract labourer are exploited by means of various social issues that includes social, legal, physical, mental, even financial and side by side women, old age person and children of 12-18 years are exploited very much. Simultaneously, outsourced contract labourer are also exploited by their master, contractor or employer. Now the thing is that whether contract labourer are part and parcel of that exploitation. They are exploited by means of payment of wages, social security, health, food and residence. Such labour can be distinguished from the direct workers in terms of employee-employer relationship and the method of wage payment. The contract labour does not have any direct relationship with the principal employer. It has a distinct way of working unlike in any other classes of labour like permanent, temporary, casual etc. the contract labour system is based on the relation made by employer, contractor or contract labour. The workers are recruited by an outside agency or person and are supplied or outsourced to an establishment or engaged on its work. Unlike direct labour, they neither have the muster roll of principal employer/ establishment nor paid directly.
