Title

Strike on Right to Strike: The Labour Code Industrial Relations Bill, 2015

Abstract

Strike is the most important tool in the hands of the workmen. It is a facet of collective bargaining. Any attempt to curtail the right to strike tantamount to dilute the very right of collective bargaining. The new Labour Code Bill, 2015 has consolidated three acts with several changes brought about in them viz. The Trade Union Act, 1926, The Industrial Employment (Standing Order) Act, 1946 and The Industrial Disputes Act, 1947. One of the proposed changes brought about in matters relating to strikes and lockouts is a matter if concern as it aims to provide for stringent prohibitions in declaration of strikes. This paper highlights the proposed changes in the new bill which if accepted will curtail the ‘right to strike’.
