Title

Models of Secularism - Comparative Perspective

Abstract

This paper compares different secular model present in the world, as Wall of separation model in United states of America to French Idea of Secularism. India has a Unique idea of Secularism since independence, the issue of secularism has been the focal point of discussion. With the coming of judiciary as the guardian of the constitution, and the recent statement of the Chief Justice of India, i.e., “Judiciary is the guardian of the constitution and the minorities as well.” Adding to it, issues such as triple talaaq and personal law under article 13 , become more complex and draw the researchers towards a coherent enquiry. In Kesavananda Bharati (1973) the apex Court has recognized that the law of the land has certain basic feature which got the fundamental importance, establishing the basic structure doctrine, the fundamentals that were outside the amending authorities of the Parliament. Secularism was included as one of the basic feature. In 1975, the election case came, i.e., Indira Nehru Gandhi, the judiciary held that secularism was inalienable or immutable from the Constitution. On those cases court refrain itself from defining the meaning of secularism but if we look into the judgments, in few paragraphs it seems that the judiciary was approaching the matter with the model of western secularism that exclude the State from the religion. this paper highlights the area where Indian notion of secularism is different from western approach of secularism.
