Title

comparative analysis between personal laws and criminal laws

Abstract

The objective of any enactment is to protect the right of a person. There are various legislations which are intended to provide a remedy in the case when any right is infringed. But, it is for the individual which forum he opts for enforcement of his rights. There are civil as well as criminal courts which hear the case and decide the matter judiciously. There are many occasion in which there are both remedies available to the person, he may either go to civil court or resort to criminal court. We are trying to study some provisions which are there in civil laws (personal laws) as well as criminal laws. In criminal laws there are provisions under section 125 to 128 of the code of criminal procedure, 1973 which provides for maintenance of spouses, kids and parents. Section 125 of the Code offers impact to the common and basic obligation of a man to keep up his significant other, youngsters and guardians insofar as they can't keep up themselves. This arrangement is a measure for social equity and extraordinarily ordered to ensure ladies and youngsters, additionally old and decrepit poor guardians. In Indian penal code, 1860 aswell there are provisions under the section 494 which provides for punishment for the offence of bigamy and 498A which provides to protect the married women from being subjected to cruelty by her husband or his relatives. Whereas in civil laws there are provisions under the section 11 which provides for void marriages and section 17 provides for bigamy of hindu marriage act, 1956
