Title

Surrogacy (Regulation) Bill 2019 - Successful in Paper but not in Practice

Abstract

Today the concept of “Surrogacy” stretches over the world with the help of Scientific Technology a fact which is baffling to us. Ancient Hindu Scriptures treated the marriage as a samskara or a sacramental, indissoluble union to beget a son for salvation and to discharge religious and secular duties. During that time our society also cursed the people those who cannot procure the children especially male child in their life. We believe children are gifted by god. Our parliament provides the remedy to childless parents in form of “Adoption” but many of us are not ready to adopt. The main reason is that a child will not be biologically related; apart from that, the adoptive parent in most cases will not be aware of the child’s caste, religion community and most importantly the genetic makeup of the child in case a future medical issue crops up. Before the enactment of Hindu Marriage Act 1955, system of the second marriage prevailed in our society, in some cases the first wife herself may arrange a second marriage for her husband to ensure they beget children who are biological related. But, this became barred with the enactment of Hindu Marriage Act, 1955. Hence our parliament seeks to succor the needs of childless parents via surrogacy, and regulate it via Surrogacy (Regulation) Bill, 2019. In this article we seek to study and critically analyze the Surrogacy (Regulation) Bill 2019.
