Nagabhusan v. the State of Karnataka is a judgment given by the Supreme Court in March this year. It is one among the many judgments given on similar issues as this case involves. While the court relies on judicial precedents in deciding the case, the author suggests that an emancipated approach be taken with respect to an accused who has made any efforts to stop the commission of the offence after having attempted it. The author relies on tenets of reformation adopted in the Indian criminal jurisprudence and an alternate interpretation of Section 300 of the Indian Penal Code, 1860 in order to support her case.
