Title

VICTIM COMPENSATION JURISPRUDENCE IN INDIA : A MYTH OR REALITY

Abstract

Crime causes economic loss, emotional trauma, and physical, psychological, or spiritual injury to victims and their family, in addition to violating a criminal code. In all offenses, the accused and his rehabilitation have been the focus, but nowhere are victims of crime paid any attention or the status of crime victims completely ignored. The main aim of the criminal justice system is to protect the rights of citizens and to punish the perpetrator for the crime he has committed..Compensation for crime victims by the individual or the state is becoming increasingly important today. However, it has been observed that the fundamental rights accorded citizens in the constitution are violated by various government agencies in the exercise of their administrative powers. Justice for victims has been ensured through positive action and court orders, as India has not yet passed a separate law on crime victims. Article 32 of the Constitution of India gives the Supreme Court the power to make orders or orders, including judicial orders, as appropriate for the enforcement of the fundamental rights set out in Part III of the Constitution of India. The aim of this paper is to trace the history of compensatory jurisprudence, to understand the need and purpose of victim compensation, to examine and evaluate the existing laws on compensation for victims, to understand the role of the judiciary in compensation for victims and the future of indemnity law in India.
