Title

A UNIFORM LAW FOR CYBER OBSCENITY: A POSSIBLE SOLUTION FOR TRANSNATIONAL AND BORDERLESS JURISDICTIONAL NATURE OF CYBER SPACE WITH SPECIAL REFERENCE TO ASIA.

Abstract

Crime itself a social phenomenon and it exists in our society since human being formed clan or group to live together, but it changes its nature along with change character and structure of the society. With the advancement of science and technology, our work became smooth and cheap but on the other side crime also become smooth. Due to lack of transnational and borderless jurisdictional nature of cyber world, cyber-crime becomes a big issue to be control. Out of different kinds of cyber-crime and as per NCRB report cyber obscenity/ pornography including cyber morphing increase rapidly. After go through the legal principles related cyber obscenity in different countries of Asia, we can state that a uniform pornographic law can be possible in a global sphere. Because, all the present 52 states of Asia are with the same opinion that practice of pornography are against the State’s culture, tradition and morality. Many of the countries also have strict separate law for prohibiting obscenity in their Area, some of them marked the effect of revenge pornography and non-consensual pornography and few of the countries also prohibited the practice of watching or possessing of obscene material too. India along with all other countries of the world need to signed an agreement for not encouraging any practice of obscenity in their respective countries as they all did in matter of minor obscenity in reference to Budapest Convention on Cybercrime, with a same principle of safeguard their respective culture and traditions.
