Title

Intellectual Property Rights and The Paris Convention

Abstract

The Paris Convention can best be described as the most important international agreement on Industrial Property Rights. The Convention protects industrial Property. The Convention applies to 179 member countries of the Paris Convention. Articles 1 through 12, and Article 19, of the Paris Convention (1967) apply to all 164 WTO members. For the protection of industrial Property, the Convention sets a minimum standard and gives enough freedom to member countries to conclude separate agreements among themselves. National Treatment, Right of Priority, and basic Common Rules are basic principles of the Paris Convention. These basic principles are capable enough to give confidence to people that their inventions will be protected. The TRIPS Agreement has further strengthened the Paris Convention. The agreement between the WIPO (World Intellectual Property Organization) and the WTO has a special provision for the Implementation of Article 6ter of the Paris Convention for the Purposes of the TRIPS Agreement. However, the Paris Convention lacks a system to enforce Industrial Intellectual Property. The freedom given in the Convention is enormous; enforcement of the Convention depends on the good consciousness and wish of the member countries. Therefore, the Convention should provide a specific date within which every member country must enforce the Convention in toto. For this purpose, under Article 25(1) of the Convention, a list of provisions should be inserted, which must be incorporated under the domestic law of the member countries within a given time.
