Title

The legal perspective of wildlife trafficking in India

Abstract

“The wildlife and its habitat cannot speak, so we must and we will” -Theodore Roosevelt Life on Earth includes human beings and thousands of species of other animals and plants. But Man has learnt to exploit animals, plants and other non living natural resources like land, water and minerals for his use which resulted in domestic animals and wild animals. Wildlife is an important natural resource that can be put to various uses by man but these days wildlife is getting exploited. Wildlife Trade is legal practice of transferring species to conserve and repopulate among themselves but there is also a domain of illegal wildlife trade where the animals are injured and killed for their body parts. Wildlife and forest crime is a serious and growing problem, which poses a significant threat to the environment and it negatively impacts the economic and social development, security and governance. It is said that it is the fourth largest illegal trade worldwide after arms, drugs and human trafficking. Wildlife trafficking also relates to other forms of serious crimes such as fraud, money laundering and corruption. Despite being a part of CITES, India is currently one among the top 20 countries for wildlife trafficking, and among the top 10 for wildlife trafficking by air. A large number of species are illegally transported out of the country, which makes India not only a major source, but also a transit, and destination country for trafficked wildlife and wildlife products.
