Title

From Marbury to today: a historical and comparative examination of judicial review

Abstract

The most significant piece of legislation in the nation is the Constitution. It is the "basic framework" of the state, according to Hans Kelson. All other norms receive strength and validity from the law; hence, the Constitution of a state acts as a normative framework, endorsing all other laws and actions. The idea of the rule of law has also been acknowledged by the Indian Constitution, making it the supreme law of the land. Any law deemed to be in conflict with this supreme law is void. We have a Constitution that permits judicial investigations against legislative and administrative actions, including this imbalance and any other arbitrary laws, rules, regulations, by-laws, or other initiatives. The Court evaluates the acts of the legislative, executive, and judicial branches through a process known as judicial review. It forms the basis of constitutionalism and is an essential element of the document. In the process of determining the constitutionality of legislative acts and presidential decrees from the federal and state governments, the Court is a key player. Together with England, the United States of America (USA) and India's judicial review systems are compared and examined in this study. With regard to the practical uses of judicial review, this study seeks to present a thorough grasp of the differences between India, the US, and England. With the United States of America, India, and England as examples, this research paper's main objective is to study the doctrine in the light of comparison.
