This research paper explores the legal issues surrounding LGBTQ+ rights and discrimination in India, focusing on the historical evolution, legal provisions, socio-legal challenges, and discrimination faced by the LGBTQ+ community. The paper highlights significant legal developments, particularly the decriminalization of Section 377 of the Indian Penal Code, a pivotal moment for LGBTQ+ rights in India. It also examines various landmark judicial rulings, including the Navtej Singh Johar case, which paved the way for the recognition of LGBTQ+ rights, and the NALSA judgment, which affirmed the rights of transgender persons. Furthermore, the study addresses the current discriminatory practices, such as bullying, conversion therapy, and military exclusion, that continue to impede the community's progress despite legal advances. The paper emphasizes the role of law in combating societal prejudice and promoting inclusivity while discussing the government policies designed to protect and empower LGBTQ+ individuals. Recommendations for legal reforms and societal awareness are offered, aimed at fostering a more inclusive and equitable environment for the LGBTQ+ community in India.
