Abstract
The main objective of the study is to present the evolution of the Disability Rights Movement (DRM) and to present an overview of Persons with Disabilities (PWD Act, 1995). The study, which is based on secondary data, aims to provide an overview of the recently passed "Rights of Persons with Disabilities Act, 2016" (RPWD). As a signatory to the UNCRPD, India has enacted laws and regulations relating to persons with disabilities in compliance with international conventions. Policies have been passed, aimed at ensuring equality of opportunity and full participation of persons with disabilities in the development process. Every race has people with disabilities and many of them are often discriminated against because they feel unwanted or unaccepted. Because they are human beings, persons with disabilities have the right to live with dignity, freedom, equality, safety and life. Gain knowledge about India's international legal commitments, case laws protecting the rights of the disabled, and the legislative framework of the country with this lesson. The Indian Constitution aims to ensure economic and social equality for disabled individuals, ensuring fundamental rights and a dignified life. Article 21 guarantees rights to life and personal liberty, while Article 16 mandates the State to provide employment, education, and public assistance. However, few with disabilities live with dignity, and improvements are expected in the near future. The RPWD Act, 2016, in India, aims to ensure equal rights for people with disabilities, promoting non-discrimination, active participation, equal opportunities, accessibility, gender equality, and recognition of their abilities. It also addresses mental illness, guardianship, abuse, and exploitation, establishing a foundation for citizenship and respect.
