Title

RIGHTS OF THIRD GENDER IN INDIA

Abstract

Transgender individuals experience discrimination based on their gender identity and sexual orientation. The prevailing values of culture and society often fail to acknowledge their identities and rights. They encounter numerous human rights challenges, including harassment both at home and in the community , sexual violences, discrimination at public place, unemployment, lack of medical facilities, lack of educational opportunities, mental disorders, drug abuse,problems related to marriage and social exclusion. They are entitled to all human rights acknowledged by the international conventions that India has ratified, as well as the rights provided by the Constitution. In a significant ruling, the Supreme Court has acknowledged the transgender community as the third gender in India and stated that they are entitled to all fundamental rights without any differentiation. The Court directed the government to take positive action for the improvement of their conditions.Transgender Persons (Protection of Rights) Act, 2019 represents a significant advancement in safeguarding the rights of the third gender. This paper aims to examine how well current laws safeguard the rights of the third gender community.
