Title

Transgender Rights and Social Inclusion Post Nalsa Ruling

Abstract

A transgender person is someone whose gender identity differs from the sex they were assigned at the time of birth. Often, transgender people desire medical assistance to medically transition from one sex to another; those who may do identify them as transexual. It’s been a long struggle for these people to avail their basic rights in this society as human beings. They are recoiled from society only because they do not belong to the gender which the world universally accepted as humans. This paper attempts to explore the reason behind why this has been a topic of discussion in society and how it impacts society- both positively and negatively. This paper argues about their rights and the struggles they have faced before and the hardships they are facing now. This paper further interprets and goes over with the judgment to extract a clear meaning or definition of ‘transgenders’ who are the beneficiaries of the reservation. In addition, the paper also delves into the various social challenges to the implementation of the reservation from within and outside the transgender community. Finally, this paper concludes with some suggestions and a possible way forward keeping in mind the overall upliftment and social integration of the transgender people in the mainstream.
