Title

MODERN CHALLENGES TO REGISTRATION ACT, A LEGAL PERSPECTIVE

Abstract

India's current land registration system is predominantly paper-based, making it susceptible to fraud, errors, and inefficiencies. The complexity and involvement of intermediaries further contribute to illegal land claims and unauthorized transactions, particularly affecting rural communities. This study explores the integration of blockchain technology into land registration to create a transparent, secure, and tamper-proof system that minimizes fraudulent activities while streamlining the registration process. The Registration Act, 1908 plays a critical role in governing property transactions in India, outlining mandatory and optional registration requirements. However, challenges such as identity fraud, document forgery, and outdated legal provisions hinder the system’s effectiveness. Provisions related to compulsory registration, place of registration, verification processes, and penalties for fraud are examined, highlighting the need for modernization through digital platforms. Further this paper focuses to combat fraudulent practices, implementing reforms such as digital land records, enhanced identity verification, and the adoption of blockchain technology are proposed. Therefore, the focus is on leveraging technology so that India can be more efficient, reliable and corruption-free property registration system, which ensures security and trust for the property owners.
