The market for software is expanding quickly and software has now become quintessential part present in all spheres of life. Today, without the engagement or usage of computer technology, it is impossible for any of the sectors, namely, the manufacturing sector, industrial sector, medical and health, telecommunication sector, including satellites, film industry, sports, defense, information and technological sector, and most importantly, educational sectors to survive. Every nation's economy is based on the level of technology it possesses and the level of control it wields over the computer and software industries. It contributes significantly to each nation's GDP. Earlier, it was commonly said that patents would damage the software industry rather than flourishing the industry. The research would serve as a review on these view points that existed back then. The research would also attempt to study on whether î software patentsï have become normal in the light of current scenario. The study of patentability of any invention is different from study of other intellectual property, for the reason that without having technical understanding of what the invention is, it would be nearly impossible to appreciate the legal concepts, i.e., the patentability of that invention. So the research would focus on the legal position of patentability of software in the selected jurisdictions, by analysing the law and judicial decisions and the current scenario is also analysed with the background information available at hand.
