Easementary rights in India have evolved through a combination of customary practices, judicial precedents, and legislative developments. The concept of easements grants a person limited rights over another’s property for specific purposes can be traced back to ancient Hindu and Islamic legal traditions. However, its formal legal framework was established through the Indian Easements Act,1882. This explores the historical progression of easementary rights in India, beginning with their roots in pre-colonial customs, their codification under British rule, and subsequent judicial interpretations have played crucial role in shaping the scope and applicability of easements, balancing individual property rights with societal needs. Over time, easementary rights have influenced by urbanization, environmental concerns, and modern infrastructure development, necessitating legal adaptations. This legislation provided a structured framework for recognizing and regulating rights such as right of way, right to light and air, and right to water, have adapted to changing social and economic conditions while balancing individual property rights with community welfare.
