A CRITICAL STUDY ON VICTIM COMPENSATION IN INDIA WITH SPECIAL REFERENCE TO PROCEDURE AND JUDICIAL RESPONSE IN INDIA

Abstract

An individual is a "victim" if they are hurt, unlucky, or suffer for any reason, including wrongdoing. Victimology is the study of victims of violence. It's possible that you've suffered some sort of loss or harm, whether monetary, mental, emotional, or bodily. As such, it seeks out "victims of crime," or those who have been harmed as a result of criminal activity. The primary objective of the criminal equity framework is to protect these vulnerable people from exploitation and provide them with the resources they need to cope with their circumstances. Those who had been harmed seldom found India's criminal justice system to be a pleasant experience. There have been significant shifts in the strategy of legal frameworks and the way the law treats victims in the last few decades. Punishment in the form of financial restitution to the victim for the harm or injury caused by the offender is allowed under the law. People who have been ripped off continue to get some kind of financial help. The primary objective of the Indian judicial system is to ensure that victims of wrongdoing receive adequate redress. Criminals must be punished adequately, but victims must also receive justice. To compensate victims, the Indian justice system has developed both central and state-level initiatives over time. This article will provide a summary of some of these schemes and what the law has to say about them.
