Title

WORK TO LIVE OR LIVE TO WORK: A COMPREHENSIVE REPORT ON WOMEN AND RIGHT TO WORK

Abstract

Everyone has the right to work. They work so that they may live. Does anyone live so that he/she may work? This may not be an ideal argument, but the fact remains that one has to work for his livelihood. It is possible that people may not like to work but they have no choice but to work to sustain their life. It is a universal truth that people have a human right to work or engage in productive employment and shall not be prevented from doing so. This paper brings out some staggering data from various reports and sources which reveal that a whopping 2.4 billion women of working age are being deprived of equal economic opportunity, as 178 countries still maintain legal barriers that prevent their full economic participation. In many countries, women face some form of job restriction while other countries do not guarantee equal pay for equal work. Further, women face several limitations in their job search, confront different challenging situations than men, and are unable to take up employment on short notice, leading to the ‘jobs gap’, which stands significantly higher for women than for men. This paper sums up comprehensively touching upon various limitations, laws, statutes and measures undertaken by some countries with special focus on India. Despite the existence of several laws in India, when it comes to the women and their workforce, the realities are far from what the reports and doctrinal data suggest.

Key Words

Right to work, women right to work, equal pay, employment law, new labour law right to livelihood,
