This article delves with the concept of constitutional morality which the judiciary must follow in interpreting the constitution and how it upholds the constitution’s core principles irrespective of societal prejudices. Judiciary often finds it difficult to apply constitutional morality in cases before them because it is a subjective concept with no clear definition in the constitution, which can lead to potential inconsistencies raising concerns about judicial overreach. Finally, judges must balance individual rights with the changing social landscape, ensuring that justice is always served.
