Trade Union laws in India play a pivotal role in protecting worker’s rights, advocating for better working conditions and balancing the power dynamics between labour and employers. This research critically examines the legal frameworks governing Trade Unions in India, focusing on the historical evolution, current challenges and the effectiveness of existing laws in safeguarding the worker’s rights. The paper explores key legislation, including the TRADE UNION ACT, 1926, INDUSTRIAL DISPUTES ACT, 1947 and FACTORIES ACT, 1948, along with their impact on unionization, collective bargaining and the dispute resolution. Furthermore, the research addresses the challenges posed by informal and unorganized labour sectors, as w2ell as the role of Trade Unions in the contemporary gig economy. The paper also evaluates the extent of state intervention in trade union activities and the influence of political affiliations on labour movements. The study concludes by offering recommendations to strengthen the trade union’s legal framework and enhance its role in promoting social justice and fair labour practices in India.
