Title

COPYRIGHT IN THE ERA OF ARTIFICIAL INTELLIGENCE : AUTHORSHIP, OWNERSHIP AND LIABILITY IN AI GENERATED WORK

Abstract

The rapid advancement of Artificial Intelligence (AI) has led to a paradigm shift in creative and intellectual output, challenging traditional concepts of copyright law. In the era of AI-generated content, determining the authorship, ownership, and liability of such works has become a complex legal and ethical issue. Traditionally, copyright laws have been centered around human creativity and originality. However, with AI systems capable of producing literature, music, art, and software with minimal human input, the question arises—can AI be considered an author? If not, who holds the copyright: the programmer, the user, or the entity owning the AI? Furthermore, the concept of liability becomes intricate when AI-generated work leads to infringement or harm. Legal systems around the world are currently grappling with these issues, attempting to reinterpret and reform existing laws to accommodate this new reality. Some jurisdictions emphasize the role of the human behind the machine, attributing authorship and liability to those who initiate or control the process, while others are exploring new legal frameworks. Ownership claims also vary, often hinging on the extent of human involvement in the creative process. Moreover, questions of originality, moral rights, and economic interests further complicate the legal landscape. As AI continues to evolve, it becomes imperative for legal scholars, technologists, and policymakers to collaborate in developing adaptive laws that balance innovation with accountability. Addressing these challenges is essential not only to protect human creators but also to ensure responsible use and development of AI technologies.
