Title

Substantial question of law; a sine qua non of Second Appeal

Abstract

A litigant has a right to get justice at the hands of the state. Indian legal system provides three tier dispute legal system for resolving disputes. Litigant has a right to file first appeal; second appeal then can approach Supreme Court of India. If the case is prolonged for a considerable long time, people will lose faith in the justice delivery system. State wants that there should be an end to the litigation. How this finality of judgement be secured? The amendment to sec 100 Civil Procedure Code makes it mandatory that second appeal can be filed by the litigant only when the case involves ‘Substantive question of law’. In this article an effort is made by the author to find out the meaning and importance of the concept ‘substantive question of law’ with the help of some landmark judgements of the Supreme Court.
