Legal Consequences of Drug Possession and Trafficking in India: An Overview of the NDPS Act, 1985

Abstract

India’s legal framework for dealing with drug-related offences is enshrined in the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, one of the most stringent anti-drug laws in the world. The Act covers all aspects of narcotic drugs and psychotropic substances—cultivation, manufacture, possession, sale, transport, and trafficking. This article provides a detailed overview of the legal consequences associated with drug possession and drug trafficking in India, examining the key provisions, penalties, judicial interpretations, and rehabilitation opportunities available for offenders.
