Title

Cyber Forensics Investigation and Adjudication of Cybercrime Cases in India: A Critical Analysis

Abstract

Every member of society suffers as a result of crime in some way. Due to the Internet's quick spread and the digitization of business practises, cybercrime is rapidly expanding throughout the world. Technology has become so pervasive that it is quite impossible to avoid using computers or even our mobile phones. It has provided enormous opportunities for cyber-offenders to use cutting-edge tools to commit crimes. As a result, one of the most difficult tasks for law enforcement agencies in cybercrime investigations is locating, analysing, and extracting critical forensic digital material from the networks involved in the crime in order to identify the perpetrators. As per the National Crime Record Bureau (NCRB), in the year 2022, 69123 cybercrime cases were pending for investigation, out of which a total of 35835 cases have been disposed of by the police, and the pendency percentage has been recorded as 48.1%. Similarly, the courts have resolved 4269 out of the 40190 cases scheduled for trial, with 35921 cases still pending. As a result, according to the NCRB Report 2022, the pendency percentage of cases awaiting trial is 89.4%. In this paper, the author has made an attempt to analyse the cyber-forensics mechanisms involved in the investigation and adjudication of cybercrime cases in India and also analyses the reasons behind the high pendency rate for investigation and trial in cybercrime cases.
