There are three main organs of the government in a state . The first is legislature second is executive and the third the judiciary. According to the theory of separation of powers- in a free democracy these organs of the government must act in separation. They must not interfere with each other’s functions. They must act within their jurisdiction. But due to the complexity of the democracies in the world ,the overlap in the jurisdiction is bound to arise ,so there is a provision of checks and balances , according to which every organ keep checks on other organs of the government .The present article attempt to analyse the origin ,meaning and relevancy of the doctrine of separation of powers in India . Further it also highlights the constitutional provisions and judicial precedents revolving the same in details
