The relationship between contract law and labour law reflects a complex interplay between individual autonomy and social justice. While contract law is premised on free will, equality of bargaining power, and enforceability of private agreements, labour law seeks to redress the inherent imbalance in employer-employee relationships. In India, employment relationships often originate from contracts governed by the Indian Contract Act, 1872, but evolve under the influence of protective labour legislation. This article critically examines the foundational role of contract law in shaping labour rights, with a focus on how it operates in practice within informal and formal sectors. It explores the doctrinal principles of consent, consideration, and inequality in bargaining power, and analyzes key judicial pronouncements. The article argues for a harmonized framework where contract law complements labour law by ensuring fair, enforceable, and just agreements, especially in the informal economy.
