The Covid-19 pandemic has accelerated digital transformation, leading to the Aadhaar project and the Data Protection Act. The Act addresses concerns about data exploitation and privacy violations, focusing on privacy-by-design concepts in technology development. Businesses are encouraged to include data security features in their products. The government has reinforced cyber security frameworks through programs like the National Cyber Security Policy. However, India's rapid transformation has created a fertile ground for new cyber threats. The pace of technological change and digital adoption has outstripped India's legal and institutional frameworks to respond. The Digital Personal Data Protection Act, 2023, is a modernizing step, but the existing legal architecture remains reactive. To build a resilient cyber ecosystem, India must transition from a reactive to a proactive and adaptive policy model, leveraging strategic public-private partnerships, investing in law enforcement capacity-building, and formalizing a technology-neutral legal framework.
