Title

Transformative Constitutionalism in the Global South: A Study of India and South Africa

Abstract

Abstract Transformative constitutionalism is a progressive legal philosophy that views the Constitution not merely as a document of governance but as a living instrument for achieving social, political, and economic justice. It envisions the law as an agent of change, capable of transforming historically unequal societies into inclusive democracies. This paper explores the concept of transformative constitutionalism in the context of the Global South, focusing particularly on India and South Africa—two nations that emerged from colonial and apartheid regimes marked by deep structural inequalities. In India, transformative constitutionalism manifests through the dynamic interpretation of the Constitution by the judiciary, especially in landmark cases such as Kesavananda Bharati, Maneka Gandhi, and Navtej Singh Johar, where the courts expanded fundamental rights and reinforced the idea of constitutional morality envisioned by Dr. B.R. Ambedkar. Similarly, South Africa’s 1996 Constitution, rooted in the philosophy of Ubuntu, institutionalizes socio-economic rights and human dignity, with the Constitutional Court playing a vital role in bridging the gap between legal ideals and social realities through decisions like S v. Makwanyane and Government of the Republic of South Africa v. Grootboom. The comparative study reveals that while both nations share a common transformative vision, their methods differ—India’s being judge-driven through interpretation, and South Africa’s being text-driven through explicit constitutional guarantees. Despite challenges such as judicial overreach, implementation gaps, and socio-economic constraints, transformative constitutionalism continues to evolve in response to emerging issues such as digital privacy, gender equality, and environmental justice. Ultimately, this paper concludes that transformative constitutionalism is not a static concept but a continuous process of aligning constitutional principles with social realities. It reinforces the belief that democracy must go beyond formal procedures to truly transform lives, uphold human dignity, and ensure justice for all.
