Title

INDIA AND FOREIGN ARBITRAL AWARDS: EXAMINING KEY ISSUES AND SOLUTIONS IN LIGHT OF THE 2024 DRAFT BILL

Abstract

ABSTRACT In international commercial arbitration, India's handling and enforcement of foreign arbitral awards are crucial. India has long aimed to make arbitration more accessible through the Arbitration and Conciliation Act, 1996, which is the country's domestic implementation of the UNCITRAL Model Law and the New York Convention. However, judicial practice, doctrinal ambiguities (particularly regarding "public policy"), and procedural hold-ups have occasionally eroded trust in India as a venue for arbitration and a trustworthy venue for the enforcement of foreign awards. Significant changes pertaining to enforcement, judicial review, and the finality of awards are proposed in the Draft Arbitration and Conciliation (Amendment) Bill, 2024. This article looks at the main issues affecting foreign arbitral awards in India, evaluates the possible effects of the Draft Bill and suggests workable legal, institutional and procedural solutions to balance corrective judicial oversight with the New York Convention regime's demands for finality and enforceability.
