Title

Reskilling and Upskilling as legal and Managerial Imperatives in an AI driven Era: A combined Legal and Management Perspective for India

Abstract

Artificial Intelligence (AI) is transforming the world of work at an unprecedented pace, automating not only repetitive tasks but also cognitive functions such as decision-making and planning. While this technological shift generates new opportunities, it simultaneously displaces traditional jobs, creating widespread skill obsolescence. In this context, reskilling, equipping workers with new capabilities and upskilling, enhancing existing abilities emerge as critical management strategies to ensure employability and equitable participation in the AI-driven economy. In India, with its vast youth population and growing digital economy, the stakes are particularly high. Although the Government has introduced policy frameworks such as the Skill India Mission, Pradhan Mantri Kaushal Vikas Yojana (PMKVY), and the National Education Policy (NEP) 2020, these remain policy initiatives without legal enforceability. Displaced workers currently lack rights-based guarantees for reskilling, leading to a mismatch between aspirational policy rhetoric and constitutional commitments to livelihood and social justice. This paper examines reskilling and upskilling as potential tools for legal and management efficiency in India. It analyses the literature related to management policies and provisions such as Articles 14, 21, 39(a), 41, and 46, and judicial precedents that have expanded socio-economic rights, including Olga Tellis v. Bombay Municipal Corporation (1985) and Unni Krishnan v. State of Andhra Pradesh (1993). By drawing on comparative models such as Singapore’s SkillsFuture, the European Union’s employer-funded initiatives, and Germany’s Work 4.0, the study highlights lessons for India. The paper proposes a comprehensive “Future of Work” law embedding reskilling obligations on the State and employers, ensuring equitable access to digital literacy, and protecting vulnerable groups. Recognizing reskilling as a legal right would not only align India with global best practices but also operationalize constitutional guarantees, making technological transition inclusive and socially just.
