Title

CONTRIBUTION OF INDIAN JUDICIARY AND PUBLIC INTEREST LITIGATION

Authors

Abstract

Pandemic times have brought lots of changes in people’s working habits, technology, demography, competitiveness, conflict, ideology, political life, economic policy, and legal principles. Even in the midst of these difficult times, the contribution of the Indian judiciary in the form of judicial activism touched its highest peak with lots of landmark judgements directly affecting the common man and the business fraternity alike. If we look at the historical judgments of the Supreme Court, the Apex Court of the country has risen to the occasion to function as the powerful wing of the government. Neo normalcy after the Covid era has seen evolutionary legislation on the part of our parliament also. Democracy in India is moving ahead many steps further with its latest socio-economic policies with the changes in technology. The country is witnessing an enthusiasm like never before. The judiciary strikes down laws that are unconstitutional by the process of judicial review. Our judiciary has revolutionized the locus standi concept through public interest litigation, where a public-spirited person can take initiatives against injustice. The judiciary guarantees civil and political rights, takes active steps to ensure economic, social, and cultural rights, and takes actions to protect group rights. The Directive Principles of State Policy mentions the basic guidelines that the welfare state of India has to follow while framing legislation for the masses. The Indian Judiciary is leading us towards a progressive society by elevating most of the Directive Principles into fundamental rights. Above all, the judiciary in India plays a vital role in upholding the rule of law, protecting the rights of citizens, and ensuring that justice is served. Liberty and justice are hailed as the hallmarks of Indian democracy.
