Title

CORRUPTION AS A VIOLATION OF FUNDAMENTAL RIGHTS: AN EXPANDING CONSTITUTIONAL PERSPECTIVE

Abstract

Corruption, once regarded mainly as an administrative or ethical problem, is now increasingly recognized as a violation of core constitutional rights, directly threatening the values of equality, liberty, and justice as enshrined in India’s Constitution. This article examines the movement in legal and judicial attitudes, tracing how corruption has progressed from being presented as a moral or governance concern to being viewed as an infringement of cardinal basic rights, namely those under Articles 14, 19, and 21 respectively. Landmark Apex Court decisions, such as Centre for Public Interest Litigation vs. Union of India (2012) and State of Madhya Pradesh v. Ram Singh (2000), have impacted judicial understandings of corruption as a barrier to constitutional administration and the rule of law. The studies show that when there is corruption, there is inequitable distribution of public wealth, the public's democratic rights to equality and dignity are not respected, and there is an erosion of the public's democratic trust. In addition, there has been an increasing tendency of the courts to situate anti-corruption measures within the scope of constitutional morality and good governance. The article argues that conceptualizing corruption as a disregard of the basic rights of the people broadens the scope of the legal instruments available to curb corruption and at the same time, promotes the values of the constitution such as transparency, accountability, and socio-economic justice.
