Title

The Principles of Natural Justice in Indian Administrative Law

Abstract

The principles of natural justice constitute the foundational framework for fairness in decision-making within administrative, quasi-judicial, and judicial processes. Although these principles are not expressly codified in the Constitution of India, Indian courts have consistently recognized them as indispensable elements of the rule of law. Natural justice primarily rests upon two cardinal rules: nemo judex in causa sua (no one should be a judge in his own cause) and audi alteram partem (hear the other side). Over time, Indian jurisprudence has expanded these principles to include procedural fairness, reasoned orders, transparency, and accountability. This research article undertakes an in-depth doctrinal and judicial study of natural justice in Indian administrative law. It traces the historical origins of the doctrine, examines its constitutional status, analyses the rule against bias and the rule of fair hearing along with their sub-components and exceptions, and critically evaluates landmark judicial pronouncements. The study further explores the contemporary relevance of natural justice in modern governance and concludes that adherence to these principles is essential for ensuring legitimacy, public confidence, and justice in administrative decision-making.
