Title

ROLE OF MEDIA AND ITS EFFECT ON CRIMINAL JUSTCIE SYSTEM: A CRITICAL STUDY

Abstract

Apart from being an important source of information for the people, media is also considered as the fourth pillar of a democracy. Its role in the democracy cannot be disavowed. It is the primary source of knowledge and ideas. The constitution of India under Article 19 expressly mentioned that freedom of speech as a basic right and it covers right to the press also. Right to information also directly flows from right to speech and expression. The citizens have right to know and they form their opinion on the basis of information received through new forums. It is the imperative obligation of media to disseminate the right information for the awareness of people and it has to perform its duty with integrity, fearlessness and responsibility. However, with the passage of time there has been an expansion in the functions of media. The right to privacy and the right to a fair hearing are just as important as the freedom to publish. There has been a surge in the incidences of media trials of an accused which has serious repercussions in the criminal justice system while court pronouncing its judgment. This process is known as media trial. It does not give the media the status of a court; still it has a pliable influence on the justice delivery system. It affects the basic rights of accused and it hampers the criminal justice system also. The present paper is an attempt to understand the media trial trend and its effect on the implementation of criminal justice system.
