Title

Application of 'doctrine of deeming fiction' in remedying the concerns of Nature and its environment.

Abstract

Mankind’s responses to justiciate the concerns of Nature and its environment have been ignobly hypocritic and defensively ignorant so far. We derive our sources from the Nature and royally deny it – it’s worth, our accountability towards it and, any remedy to it what so ever, because of our individual insecurities and collective lack of wisdom. Such ineptitude in dealing with our source of existence is akin to a recipe of mass suicide, which would be the greatest unnatural event in the histories of both the nature and mankind in tandem. The scope of this article is an attempt of retelling the gravity of existing threats to Nature from legal perspective; redefining the characteristics of the threat impending in terms of legal doctrines viz. doctrine of parens patriae and doctrines of liability. Considering the scale of anomalies that the Nature is exhibiting currently, one does not need a scientific orientation to experience it. The cliché of Climate Change is palpably apparent by mere standards of legal cognition i.e. ‘by prudence of an ordinary man’. A possible mitigation with respect to the crisis at hand can be modeled upon the most successful legal discovery of our civilization – viz. doctrine of incorporation or deeming fiction. It is time that we apply this doctrine to identify the Nature as a ‘legally alive entity’, so that it can be provided with set of rights, it can be remedied for violations to it and other such legal recourses. The emerging necessity is to think beyond the existing methods of provisioning the Nature its dues. We have forced the Holocene into a twilight zone; Science suggests that the damages done as such are irreversible. This paper seeks to suggest legal remedy to injuries of Nature, if not to repair, at the very least for their containment.
