Title

FROM COLONIAL LEGACY TO CONTEMPORARY CHAOS: NAVIGATING THE CHALLENGES OF INDIA'S REFORMED CRIMINAL JUSTICE SYSTEM

Abstract

The recently passed criminal laws, which were praised for eliminating rules from the colonial era, have sparked controversy and legal dilemmas about their actual implementation. The laws have been implemented without proper preparation and training of law enforcement machinery for such change. The implementation of new laws requires adaptation of new procedures, interpretations and such possible loopholes which need to be addressed by the judiciary and legislators by such amendments. It can be a potholed road for both litigants and lawyers. Effective implementation of such laws requires supplementary training for the law enforcement and the administration to minimize disruptions arising out such implementation. The Judiciary may come across unanticipated challenges while interpretation and application of such laws which can lead to uncertainty. This hastened implementation may further complicate the legal system which is already burdened with backlogs. Moreover, changes in Adjective law can elevate the administrative hardship. Coming up with the impact of implementation of these laws, there will be possible infringement of civil liberties by the insertion of sedition laws which the constitutional court has struck down earlier. The provisions relating to terrorism, accident cases, marital offences etc. requires greater consultation with stakeholders. The extension of police custody up to 90 days, empowering investigation agency with more powers of arrest and detention and discretion without sufficient checks and balances will definitely dilute the civil liberties which the constitution has provided and will have a chilling effect on freedom of speech and expression. Unfortunately, the new criminal laws have failed to address the existing loopholes in both substantive and adjective laws. Moreover, provisions for state surveillance have raised privacy concerns. In the end, a more deliberate and comprehensive strategy is required to guarantee that the criminal justice system advances the goals of equality, justice, and human rights. In this background, the authors of the research paper would venture into the impact of hasty implementation of new criminal laws, by examining the intent and impact of these reforms in the criminal justice system highlighting potential risks to Justice, human rights, societal well being and how it impacts the misappropriate impact on marginalized communities.
