Title

Legal Frameworks of Dispute Resolution in various sectors

Abstract

"Find justice through collaboration and negotiation, not confrontation" – ADR is that one method that confines to this line. Mechanisms for dispute resolution better than the existing ones form the backbone of legal development in an age where delay equals denial of justice. In this regard, the research features the legal frameworks on dispute management across various jurisdictions, arguing first and foremost that proper regulation is the best way to secure fair outcomes and, therefore, social stability. In the current research, the authors have investigated the legal infrastructure, rules, regulations and institutional framework regarding key sectors within commercial, labour, environmental, and family law domains with an overall objective of determining the present situation of the dispute resolution system. The study uses these methods to assess the efficiency of ADR instruments such as mediation, arbitration, and negotiations about conventional litigation. It focuses on the participation of legal representatives and independent directors and the importance of each sub-sector to adapt to better suit the needs of the conflict resolution process. Furthermore, the paper examines the implications of technological advancement and its relation to laws and legal procedures concerning integrating ODR platforms to address contemporary disputes. The outcome of this study would be highly relevant for decision-makers, practitioners, and scholars. A prominent lesson derived from this study is the approach of integrative conflict resolution, where collaboration should be factored in to address the everyday needs of the actors and serve the purpose of fairness within the legal system. The paper also presents actionable suggestions that can be implemented to improve existing models, thereby addressing the complex challenges of the legal framework for the benefit of society.
