Title

ASSESSING THE IMPLEMENTATION AND IMPACT OF NEW CRIMINAL LAWS WITHIN EVOLVING LEGAL FRAMEWORK

Abstract

To meet societal challenges and to address the contemporary challenges, due to which there was a recent overhaul in the India’ criminal justice system, which introduced the three new laws- the Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA), which commenced from 1st July 2024. The aim of these three new criminal bill was to modernize the legal framework which is made in the colonial era, and to align with democratic values. The BNS has introduced specific provisions in the act, to address organized crimes to safeguard the nations from terrorist activities, community services as an alternative option for penalty, and made revision in the penalties between the minor and serious crimes to increase deterrence. The BNSS has given the timelines for investigation and introduce mode digital methods, trial, and inquiries with the aim to reduce the delays in the proceedings. Also, the use of digital technologies has increased, such as E-FIR, audio- video recording of evidence to build up the transparency. The recent reforms has also mandates the forensic teams to conduct investigations in the serious offences to better the evidence. And the BSA, has upgrade the system of evidence to include the electronic records due to the digital era, and also approves the admissibility in the court proceedings to keep step with the technology. The implementation has made a remark on the citizen to boost their confidence in the judiciary system to enhance fairness, transparency and accountability. And these laws has break the limitation for the citizen and there is more accessibility and efficiency. To meet this impact, there need of proper training of police and judicial officers under this new laws, there is requirement of more development in building the forensic labs and infrastructure and requisite for proper administration of court systems.
