Title

Copyright Violations in the Indian Music Industry: Challenges & Legal Perspectives

Abstract

Copyright violations in the Indian music industry have become an increasingly significant issue, impacting both established and emerging artists. With the rapid growth of digital platforms and the widespread use of the internet, music has become easily accessible, leading to a rise in unauthorized reproductions, streaming, and distribution. This unauthorized use not only deprives musicians of their rightful earnings but also undermines the creative value of their work. The situation is further exacerbated by the lack of awareness and understanding of copyright laws among the public and many industry stakeholders. Legal perspectives on copyright infringement in India are rooted in the Copyright Act of 1957, which has undergone several amendments to address the evolving challenges in the digital age. However, despite these legal provisions, enforcement remains a major concern due to slow judicial processes and the increasing sophistication of digital piracy. Music piracy, particularly through illegal downloading and streaming platforms, poses a significant threat to the sustainability of the industry. Furthermore, many artists struggle to assert their copyright claims effectively due to limited resources or lack of proper legal representation. The role of government agencies and industry organizations has become crucial in combating these violations. In recent years, efforts have been made to strengthen copyright enforcement, with the introduction of more stringent regulations and increased cooperation between stakeholders. Nevertheless, there is still a long way to go in curbing copyright infringements and ensuring fair compensation for artists. The legal frameworks must continue to evolve to better protect the rights of creators in the ever-changing digital landscape.
